Welcome to STOKED GOLF LLC. By booking our services, submitting a deposit, or participating in the use of our mobile golf simulator, you agree to the following Terms & Conditions.
1. Bookings & Deposits
A deposit is required to reserve your requested event date and time. A booking is not considered confirmed until the required deposit has been received and confirmation has been provided by STOKED GOLF.
Any remaining balance must be paid according to the payment terms provided at the time of booking.
2. Cancellation & Refund Policy
If a customer cancels at least 48 hours before the scheduled event, 50% of the deposit will be refunded.
If a customer cancels within 48 hours of the scheduled event, the deposit is non-refundable.
STOKED GOLF LLC may make exceptions or offer rescheduling at its discretion in situations involving severe weather, unsafe conditions, emergencies, or other circumstances outside the reasonable control of either party.
3. Weather & Outdoor Events
For outdoor events, weather conditions must allow the simulator and related equipment to be operated safely.
STOKED GOLF LLC reserves the right to delay, suspend, relocate, modify, or discontinue operation if rain, lightning, excessive wind, extreme temperatures, or other conditions create a safety risk or could damage equipment.
When possible, STOKED GOLF LLC will work with the customer to find a reasonable solution, including relocation or rescheduling.
4. Setup & Venue Requirements
The customer is responsible for ensuring that the event location provides adequate space and reasonable access for the delivery, setup, operation, and removal of STOKED GOLF LLC equipment.
The customer is also responsible for obtaining any necessary permission from the property owner, venue, event organizer, or other appropriate party before STOKED GOLF LLC arrives.
Additional charges may apply if significant delays, access restrictions, or unexpected venue requirements interfere with setup or removal.
5. Safety & Simulator Use
All participants must follow instructions provided by STOKED GOLF LLC staff.
Only one participant may swing a golf club within the designated hitting area at a time. Guests must remain a safe distance from anyone swinging a club.
STOKED GOLF LLC reserves the right to prevent or discontinue participation by any individual who is using the equipment improperly, behaving recklessly, refusing to follow safety instructions, or otherwise creating a risk to themselves, other guests, staff, property, or equipment.
6. Alcohol & Impaired Participants
Alcohol may be present at certain events; however, participants are responsible for using the simulator safely.
STOKED GOLF LLC reserves the right to refuse simulator use to any person whose level of intoxication, behavior, or condition creates a safety concern.
No refund or extension of booking time will be required when participation is denied for safety reasons.
7. Assumption of Risk
Participation in golf-related activities involves inherent risks, including risks associated with swinging golf clubs, golf balls, equipment, surrounding participants, and physical activity.
By participating, guests voluntarily assume the ordinary risks associated with using the golf simulator and participating in golf-related activities.
Participants are responsible for determining whether they are physically capable of safely participating.
8. Equipment Damage
Customers and participants are expected to treat all STOKED GOLF LLC equipment with reasonable care.
The booking customer may be held financially responsible for damage caused by intentional acts, reckless behavior, negligence, misuse of equipment, or failure to follow instructions.
Normal wear and tear and equipment failures not caused by the customer or guests will not be charged to the customer.
9. Event & Venue Property
STOKED GOLF will use reasonable care during setup, operation, and removal of its equipment.
The customer should notify STOKED GOLF LLC in advance of sensitive surfaces, underground irrigation, restricted areas, unusual venue conditions, or other circumstances that may affect installation.
STOKED GOLF LLC is not responsible for damage resulting from undisclosed conditions at the event location or instructions provided by the customer or venue.
10. Event Timing
Your reserved rental period begins and ends at the times agreed upon during booking.
If operation is delayed because the customer, venue, or event organizer is not ready or cannot provide access at the agreed time, the original scheduled end time may still apply.
Additional time may be purchased when available and subject to STOKED GOLF LLC approval.
11. Equipment or Technical Issues
STOKED GOLF will make reasonable efforts to provide fully functioning equipment throughout the event.
If a significant technical issue caused by STOKED GOLF equipment prevents simulator use for an extended period, STOKED GOLF LLC may, depending on the circumstances, provide additional time, a partial refund, credit, or rescheduling.
Temporary interruptions caused by internet availability, venue power, weather, or circumstances outside STOKED GOLF LLC’s reasonable control may not qualify for a refund.
12. Right to Suspend or Terminate Service
STOKED GOLF reserves the right to immediately suspend or terminate simulator operation if conditions become unsafe, equipment is being intentionally or recklessly damaged, participants refuse to follow instructions, or STOKED GOLF LLC staff are subjected to threatening, abusive, or dangerous behavior.
Refunds will not be provided when service is terminated because of unsafe or inappropriate conduct by the customer or their guests.
13. Children & Minors
Children and minors must be appropriately supervised by a parent, legal guardian, or responsible adult while using or being near the simulator.
The booking customer is responsible for ensuring appropriate supervision throughout the event.
14. Photos & Video
STOKED GOLF LLC may occasionally capture photos or video of its equipment and event setups for promotional purposes.
If identifiable guests are to be prominently featured in marketing materials, STOKED GOLF LLC will obtain appropriate permission when required.
Customers may request that their event or guests not be photographed for promotional purposes.
15. Limitation of Liability
To the fullest extent permitted by applicable law, STOKED GOLF LLC will not be responsible for indirect, incidental, special, or consequential losses arising from the use of its services.
Nothing in these Terms & Conditions is intended to waive or limit rights or liabilities that cannot legally be waived or limited under applicable law.
16. Personal Belongings
STOKED GOLF LLC is not responsible for lost, stolen, forgotten, or damaged personal belongings at an event.
Participants are responsible for keeping their personal property secure.
17. Force Majeure
STOKED GOLF will not be responsible for failure or delay in providing services due to circumstances reasonably outside its control, including severe weather, natural disasters, government restrictions, power outages, venue closures, transportation emergencies, or similar unforeseen events.
STOKED GOLF LLC will make reasonable efforts to work with affected customers regarding rescheduling when appropriate.
18. Privacy
Personal information collected through the STOKED GOLF LLC website or booking process will be handled in accordance with our Privacy Policy.
19. Changes to These Terms
STOKED GOLF LLC reserves the right to update these Terms & Conditions when necessary. Changes will become effective when the updated terms are posted on our website.
The terms applicable to a confirmed booking will generally be those presented to the customer at the time of booking unless otherwise agreed.
20. Governing Law
These Terms & Conditions are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
21. Acceptance of Terms
By submitting a deposit, completing a booking, or participating in STOKED GOLF activities, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
